Question: Asalamualaikum warehmatuLLAHI wabarakatuhu…is it not true that in the hanafi fiqh it is wajib to offer umre qadha missed prayers ? I would please require some evidence from the sunnah or any other convincing hadith to prove this as i am being told that there is no basis for the concept of umre qadha. Also i would like to know if the maliki, hanbali and shafai fiqhs agree to the offering of umre qadha as being a wajib act .please reply soon.
Wa Alaikum Salaam,
Umra e Qadha which refers to making up one’s missed Salaah is essential upon a person who has missed Fardh salaah in the past, and this is evident from authentic traditions of the Prophet (S.A.W).
In this regard, the Prophet (S.A.W) is reported to have said: ‘If one missed Salaah on account of sleep or became unmindful of it, then he must perform it when he remembers it, for verily Allah says, establish salaah for My
remembrance.’ (Muslim from Anas bin Malik). In the hādith of Sahih Bukhari, it mentions that the Prophet (S.A.W) said: ‘Whoever forgets to perform Salaah, let him perform it when he remembers it. There is no expiation for it except this.’ (Bukhari).
It must be noted that salaah is a duty that Allāh has imposed upon the believers, and it is a responsibility upon them to fulfill it. In this regard, the Prophet SAW said: ‘the debts and duty owed to Allah, it is more rightful that it be fulfilled.’ [Bukhari]
On account of the above-mentioned traditions, the great Imams of Fiqh and the overwhelming majority of scholars have stated that is essential upon a person to make up for his missed salaah. They have stated, ‘whomsoever salaah is essential upon, and has missed it by missing the time that is fixed for it, then making it up (its Qadha) will be necessary upon this person.’ (Al Fiqh Al Islami Wa Adillatiha Vol.2 Pg. 1148 – Al Kitaab Ma Al Lubaab; Ash Sharh As Sagheer; Mughni Al Muhtaj; Al Muhazzab; Al Majmu’; Al Mughni; Bidayah Al Mujtahid).
So from this, it is clear that making up for one’s missed salaah is wajib in the Fiqh of Imams Abu Hanifah, Malik, Shafi’ and Ahmad ibn Hanbal (A.R).
And Allah Knows Best.
